By using PixyVue, you agree to be bound by these Terms. If you're using PixyVue on behalf of an organization, you agree to these Terms on behalf of that organization.

The trademarks, names, logos and service marks (collectively "trademarks") displayed on this website are registered and unregistered trademarks of PixyVue. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of PixyVue. The written content displayed on this website is owned by its respective author and may not be reproduced in whole, or in part, without the express written permission of the author.

Your Media Files

You can store files (for example photos, videos and documents) for backup and sync across devices logged into your PixyVue account. The materials you upload to PixyVue are yours and yours alone. You permit us to use that material solely to do what's necessary to provide our services, including storing and displaying those materials through our web application and mobile apps.

We don't sell the files you store with us to third parties, and we don't use them for advertising purposes. We can disclose your files only in the limited circumstances described in our Privacy Policy.

Your Responsibilities

Your use of our services must comply with our Terms and applicable PixyVue policies, as well as applicable laws, including export control laws and regulations, privacy laws, intellectual property laws, and other third-party legal rights. You are solely responsible for the development, content, and use of the files you upload to PixyVue, and you assume all risks associated with them, including intellectual property or other legal claims.

By storing files with PixyVue, you represent that you have all necessary rights to store, use and, if applicable, publicize that material and that doing so does not conflict with, violate, or misappropriate any third-party legal rights, conflict with licenses you've granted to others, violate any applicable law or regulations, or any of our Terms or applicable PixyVue policies.

Our services will allow you to share your files with others as well as publish to the web, which is in your sole control and discretion. You are responsible for taking appropriate steps to secure and protect your PixyVue account and your files, such as setting up and maintaining the proper configuration and use of our services. Please be careful about what files you choose to share.

PixyVue doesn't actively monitor the files you upload, download or share. However, we reserve the right, in our sole discretion, to remove files you store with PixyVue and suspend your access to your account in the event we become aware that your use of our services or files violates any of PixyVue's Terms or applicable policies, or any applicable law and regulations, such as copyright infringement, we learn the material is patently unlawful, we know the material is malware or supports the distribution of malware, etc.

We assume no liability for any content you or anyone else stores with PixyVue. All of the information you provide as part of the account registration and setup and ongoing use of the account is accurate, complete, and authorized by the account holder.

Prohibited Activities

PixyVue is dedicated to maintaining a secure and reliable service. We must adhere to the following prohibitions to ensure the best user experience. We reserve the right to suspend or terminate your account if you engage in any activities that violate these terms or our applicable policies:

1. Compliance with Laws

You must not engage in any activity that violates local, national, or international laws, regulations, ordinances, or directives.

2. Harassment and Abuse

• You must not engage in behavior that is threatening, abusive, harassing, defamatory, tortious, or invasive of another person's privacy.
• You must not harass, abuse, or mistreat PixyVue employees, representatives, or agents acting on behalf of PixyVue.

3. Malware and Misuse

• You must not use PixyVue's services to distribute, support, or promote malware, phishing schemes, spam, or other harmful activities.
• You must not store or transmit content containing malicious software or code intended to disrupt, damage, or gain unauthorized access to any system or data.

4. Child Exploitation

You must not store, distribute, or access any content that involves child pornography or any material that exploits or abuses children. This includes content that is illegal under applicable laws and regulations.

5. Interference with Services

• You must not interfere with PixyVue's software, hardware, or equipment properly functioning. This includes disrupting network services or engaging in denial-of-service attacks.
• You must not engage in any conduct that impairs or restricts others' use of or enjoyment of our services or that could harm PixyVue or its users.

6. Automated Access

• You must not monitor, copy, or extract material from PixyVue's services using automated methods, such as scraping, harvesting, or other means, without prior written consent from PixyVue.
• You must not attempt to gain unauthorized access to PixyVue's systems or data, including bypassing security measures or authentication protocols.

Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information. You represent to us that you have provided all necessary privacy notices and obtained all necessary consents. You are responsible for the storage and use of your files in accordance with applicable data privacy laws.

Security

We take PixyVue's security very seriously. To protect your data, all files stored on PixyVue are encrypted using industry-standard 256-bit encryption protocols. This ensures that your files are secure and can only be accessed by authorized devices. Only devices that are logged into your PixyVue account can decrypt and unlock your files.

Age Requirement

PixyVue is intended solely for users who are 13 years of age or older. In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we become aware that an account has been created by or is being used by a child under the age of 13, we will take immediate steps to terminate that account and delete any associated information.

Download and Storage Limits

PixyVue provides various storage plans to suit your needs. If you exceed your download or storage limits, we will alert you via email or through notifications within the application.

If you do not reduce your download or storage usage or increase the storage limit, we may suspend download or upload functionality until you upgrade your plan or reduce your usage. This ensures fair usage for all users.

Account Creation and Access

When you create a PixyVue account, you must set your account credentials—an email address and a password you choose. You are responsible for accurately maintaining and safeguarding your account credentials. You must provide valid account credentials to log in to your account and access your files through our web application or mobile apps.

PixyVue is under no obligation to provide you access to your account or your files if you cannot provide the appropriate account credentials.

Platform Access

PixyVue is accessible through:

• Web Application: Access PixyVue directly through your web browser on Mac or Windows computers. No desktop application is required. Simply visit our website and use drag-and-drop functionality to upload your photos.
• Mobile Apps: iOS and Android applications are available for automatic photo uploads from your smartphone.
• TV Applications: Apps are available for viewing your media on Smart TVs, Apple TV, Fire TV/Firestick, Roku, and other supported streaming devices.

You are responsible for ensuring your devices meet the minimum system requirements for accessing PixyVue services.

Cancellation and Refund Policy

You may cancel your PixyVue subscription at any time through your account profile screen on the PixyVue app. Upon cancellation:

• You will retain access to your account and files until the end of your current billing period.
• After the billing period ends, your account will be downgraded to the free plan (subject to free plan storage limits).
• You will have 7 days to download your files before they are deleted from your account.
• At the end of the 7 days, your files exceeding the free plan storage limit will be permanently deleted from your account and cannot be recovered.

In case of Annual subscriptions, Your refund will be processed based on the remaining days of the billing period and the unused portion will be refunded back to your original payment method. There no refund for Monthly subscriptions. Please contact support for specific refund inquiries.

Limitations of Liability

PixyVue will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

• for any direct loss;
• for any indirect, special or consequential loss; or
• for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

These limitations of liability apply even if PixyVue has been expressly advised of the potential loss.

No Warranties

This website is provided "as is" without any representations or warranties, express or implied. PixyVue makes no representations or warranties in relation to this website or the information and materials provided on this website.

Nothing on this website constitutes, or is meant to constitute, advice of any kind.

Acceptable Use

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

As we want to provide you with uninterrupted services, we do apply limits on Download/Egress sizes to ensure fair usage for all users. To this extent, the download size for all paid users will be limited to 3x the storage limit of your plan. All freemium users will be limited to 1x the storage limit, at the complete discretion of PixyVue.

Modification

PixyVue reserves the right to revise the terms and conditions of this Agreement at any time. Any such revision will be binding and effective immediately upon posting of the revised Agreement on our website. Your continued use of our site constitutes agreement to any revision of the terms and conditions of this Agreement.

Breaches of These Terms and Conditions

Without prejudice to PixyVue's other rights under these terms and conditions, if you breach these terms and conditions in any way, PixyVue may take such action as PixyVue deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

PixyVue may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixyVue. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
